How to Protect Yourself from Mandatory Vaccination or PCR Testing - Artak Galstyan

The leader of the "Hayots Hayrenik" party, Artak Galstyan, writes on his Facebook page: "Regarding what to do when your employer forces you to take a PCR test or get vaccinated at your own expense. I have detailed this in the previous article. However, if the employer persists and tries to compel you to get vaccinated, give them this application and send us their response.

At the top of the application, just write your employer's details: the name of the institution and the name and surname of the director. In the bulleted section, fill in by hand the illnesses you have, and at the bottom, sign, write your name and surname, and date it.

The APPLICATION states that according to the (Council of Europe) Resolution 2361, the state is obliged to:

  • 7.3.1 Ensure that citizens are informed that vaccination is not mandatory, and no one can be compelled to get vaccinated through political, social, or other pressures if the citizen does not wish to be vaccinated.
  • 7.3.2 Ensure that no one suffers discrimination due to not being vaccinated because of potential health risks or lack of desire.

From the provisions listed in this resolution, it is evident that direct compulsion to vaccination is illegal, as is forcing a PCR test every ten days at the expense of the vaccinator (social pressure) or any manifestation of discrimination between vaccinated and unvaccinated individuals, such as preventing unvaccinated individuals from entering public places, charging for COVID treatment, not allowing them at work, denying bonuses, etc.

It should also be noted that according to the February 12, 2016 decision No. 29 of the Eurasian Economic Commission regarding the rules for conducting clinical laboratory tests of medical products, clinical trials must be conducted in accordance with the fundamental principles of the Helsinki Declaration of 1964 on ethical principles for medical research involving human subjects.

Particularly, in this regulation’s chapter III (Ethics Committee), it is stated that clinical trials can only be conducted if certain preconditions outlined in subpoints a), b), c), and d) are met, namely:

  1. The informed consent form, along with the description of the process of obtaining and documenting it, as well as other forms containing information for potential subjects of the trial.
  2. A description of all compensations provided to participants in return for their participation in the trial, including coverage of expenses and medical assistance.
  3. Information about the conditions of payments and compensations for research subjects.
  4. A description of the insurance conditions for participants in the research.

Currently, the contraindications for available COVID-19 vaccines in Armenia are not fully disclosed. Several leading countries, such as Finland, Japan, and Israel, have already banned the AstraZeneca, Pfizer, and Moderna vaccines in their territories, while European countries have prohibited the Sputnik V and Chinese vaccines. Clearly, we are not dealing with vaccines that have been used for decades, passed clinical trials, and accepted worldwide; rather, we are part of their clinical testing.

Based on the aforementioned, and referring to the above decision, I request the following information to decide on providing consent for vaccination or refusing it:

  1. What contraindications does the proposed vaccine have, and what potential consequences could it create for individuals with certain diseases?
  2. What substances does the proposed vaccine contain, where is it produced, what trials has it undergone, which countries accept it, and which reject it?
  3. What compensation will be provided to me for participating in the clinical trial through vaccination?
  4. What medical assistance can I expect if I experience health issues following vaccination?
  5. What amount is covered for me if I suffer mild, moderate, or severe harm due to vaccination?
  6. What amount is covered for me in the event of my death due to vaccination?
  7. Who bears responsibility for the points 5 and 6 arising from my application?
