Pashinyan's Lawyer Demands Cancellation of Interim Measures in Onik Gasparyan Case

The former Chief of the General Staff of the Armed Forces of Armenia, Onik Gasparyan, has filed a lawsuit against Prime Minister Nikol Pashinyan and President Armen Sarkissian. In response, Pashinyan's representative has submitted a motion to cancel the decision regarding the application of interim measures.

The representative of the defendant argued that the constitution does not provide for the annulment of acts adopted by law. He noted that while the restoration of labor rights is not excluded, constitutional regulations do not imply reinstatement to a position.

According to the defendant, it is not possible to record the impossibility or difficulty of enforcement of the court order, which is the basis for applying interim measures. Additionally, the lawyer addressed the recognition lawsuit, stating that if this motion were not accepted for consideration, the issue of applying interim measures would not have been discussed in this context.

The lawyer emphasized that applying interim measures has disrupted the balance between public and private interests, resulting in the subordination of public interest to personal interest.

Aram Orbelyan, the representative of the plaintiff, noted that the motion to cancel the interim measures is not based on any new circumstances, new facts, or new information that had not been known to the court. He inquired whether any new circumstances had been presented, to which the defendant responded that the only basis for the motion was an alleged judicial error that the lawyer is asking to correct, to which the lawyer positively acknowledged.

As previously reported, former Chief of the General Staff Onik Gasparyan has filed three lawsuits with the Administrative Court of Armenia contesting the legality of his dismissal from the position of Chief of the General Staff. In one of the submitted claims, the Administrative Court of Armenia granted the lawyer's motion for interim measures, which implies that Onik Gasparyan should remain in office until the final decision of the court in this matter.
