Man Accused of Violence Against Ararat Mirzoyan Has Been Arrested

The RA Supreme Court has granted the appeal of the RA Prosecutor's Office, resulting in the arrest of a person accused of violence against the President of the National Assembly, Ararat Mirzoyan. This information was announced by the Prosecutor's Office.

The investigation involves incidents of mass disturbances that occurred in various locations in the RA on November 10, 2020, particularly in the capital Yerevan, including at the government building, the National Assembly, and other state facilities and public places. The criminal case pertains to Article 225, parts 1, 2, and 4, as well as Article 301 and Article 301.1, part 1 of the RA Criminal Code.

During the mass disturbances, a specific episode of violence against the President of the National Assembly, Ararat Mirzoyan, is also under investigation. On November 12, 2020, during the turmoil in Yerevan, a group of individuals participated in acts of vandalism and violence, which led to charges being brought against J.S. under Article 225, part 2, and Article 301.1, part 1 of the Criminal Code for acts of violence against Ararat Mirzoyan.

On November 13, 2020, the Yerevan First Instance Court approved the preliminary investigation agency's motion to impose detention as a preventive measure against J.S., leading to his detention for a period of two months.

However, a complaint was filed against this decision by the defendant’s defense lawyer, which was later upheld by the RA Court of Appeals on December 17, 2020, citing a lack of substantial evidence for reasonable suspicion, resulting in J.S. being released from detention.

Following this, a cassation appeal was made by the Deputy Prosecutor General against the aforementioned decision of the Court of Appeals. Upon reviewing the appeal, the RA Supreme Court, agreeing with the Prosecutor’s rationale regarding J.S.'s direct involvement in the alleged crime, issued a decision on April 2, 2021, reversing the Court of Appeals' decision and reinstating the ruling of the First Instance Court.

To ensure the execution of this judicial act, the decision of the RA Supreme Court has been forwarded to the relevant authority, resulting in J.S.'s subsequent arrest. The preliminary investigation continues, with extensive investigative and procedural actions underway to identify all participants in the mass disturbances and provide a final legal assessment of the defendants' actions.
