Judge Rejects Nikol Pashinyan's Representative's Motion in Onik Gasparyan Case

The Administrative Court of the Republic of Armenia has rejected the motion for recusal submitted by Prime Minister Nikol Pashinyan's representative regarding Judge Mher Petrosyan.

In the case of the former Chief of the General Staff of the Armed Forces, Onik Gasparyan, against Nikol Pashinyan and Armen Sarkissian, Pashinyan's representative had filed a motion for the judge's recusal, citing concerns about the impartial and objective resolution of the case.

The court has scheduled a preliminary hearing for April 2 at 11:30 AM.

It should be noted that the Administrative Court, presided over by Judge Mher Petrosyan, had previously granted the request of Onik Gasparyan's attorney to implement protective measures in the case, aimed at halting Gasparyan's dismissal until a final judicial act in the case is reached.

On March 25, a request from Judge Mher Petrosyan was received by the Supreme Judicial Council, which promptly organized a discussion regarding the matter. Following the discussion, the Supreme Judicial Council, guided by point 18 of part 1 of Article 89 of the Constitutional Law on the Judicial Code of the Republic of Armenia, sent a copy of Judge Mher Petrosyan's request directed to the Supreme Judicial Council to the Office of the Prosecutor General to take necessary measures to address the issues raised in the request.

The Prosecutor General's Office has received Judge Mher Petrosyan's request addressed to the Supreme Judicial Council and has forwarded it to the Criminal Police. Earlier, it was reported that NSS employees visited Mher Petrosyan and attempted to enter the judge's office.
