Article 300.1 Does Not Conform to the Constitution: Decision Published on Kocharyan's Case

The Constitutional Court considered, through a written procedure, the compliance of Article 300.1 of the Criminal Code of the Republic of Armenia (which pertains to the overthrow of the constitutional order) with the Constitution, based on requests from the second President of Armenia, Robert Kocharyan, and the First Instance Court of Yerevan.

The Court determined that Article 300.1 of the Criminal Code does not conform to the Constitution.

"The Constitutional Court recognizes Article 300.1 as contradicting and invalid under Articles 78 and 79 of the Constitution," stated Arman Dilanyan, the President of the Constitutional Court.
