Onik Gasparyan Cannot Restore His Position, Badalyan Says
There is no legal case. This was stated today by Minister of Justice Rustam Badalyan during a conversation with reporters in the National Assembly, addressing the dismissal of Onik Gasparyan from the position of Chief of Staff.
"Onik Gasparyan is dismissed from his position, and Artak Davtyan has been appointed to the corresponding position. I would advise to analyze within the framework of constitutional security what it means for a decision to enter into force by law or for any event to follow by law. I believe it is inappropriate to interpret that through a legal remedy one can suspend any process or review a process that has already been completed, and these are in the realm of speculation," noted Badalyan.
Regarding the interim decision adopted by the Administrative Court, Badalyan mentioned that it does not lead to any constitutional process, and Gasparyan will not be able to restore his position.
Responding to Prime Minister Nikol Pashinyan's announcement today about Artak Davtyan's appointment as Chief of Staff, Badalyan stated: "The Prime Minister's statement is merely a record. The Constitution states that if a relevant proposal is made, and that proposal is subsequently returned by the President with objections and is not accepted by the Prime Minister, and if the President does not appeal to the Constitutional Court and does not sign, then the relevant decree by law comes into effect. In other words, today the constitutional provision has entered into force."
