Disgraceful Division in the Ministry of Defense: Will Onik Gasparyan Return to Work?
Onik Gasparyan is not removed from the position of Chief of the General Staff of the Armenian Ministry of Defense, and by law, he can return to work and fulfill his duties as Chief of the General Staff. The matter is that Judge Mher Petrosyan of the Administrative Court has accepted the case concerning the Chief of General Staff Onik Gasparyan's appeal, and Article 83 of the Administrative Procedure Code clearly states that if an appeal is filed against an administrative act and the court has accepted the case, the execution of that act is suspended by law until a final court decision is made on the matter.
This means that Onik Gasparyan should return to work. It should be recalled that on February 25, the Prime Minister of Armenia presented a proposal to the President of the Republic to relieve the Chief of the General Staff Onik Gasparyan from his position, attaching the relevant draft decree. The President returned it with objections, and on February 28, a letter was sent to the President of Armenia with the relevant justifications, resulting in Onik Gasparyan being legally relieved from his position.
Now it appears that following the court appeal, Gasparyan retains the position of Chief of the General Staff by legal force. It is also noted that Prime Minister Nikol Pashinyan has requested to appoint Artak Davtyan as Chief of the General Staff, but currently the acting Chief of the General Staff is the deputy, while the Minister of Defense Vagarshak Harutyunyan is tense with the generals. As a result, the Armenian Ministry of Defense is in the most divided state in its history today and is unable to address border defense issues. This was reported by the newspaper "Zhoghovurd."
