Robert Kocharian's Decrees Declared Invalid: Court Approves Jhangiryan's Claim
The Administrative Court has declared invalid the decrees of the second President of Armenia, Robert Kocharian, to dismiss former military prosecutor and former deputy prosecutor general Gagik Jhangiryan from office and to strip him of his class rank. This information was shared by the legal representative of the Armenian National Congress, Armen Khachatryan.
“Today, the court fully granted Gagik Jhangiryan’s claim and declared Robert Kocharian’s illegal decrees regarding his dismissal from office and stripping him of his rank invalid,” he wrote on his Facebook page.
It should be noted that Robert Kocharian had signed a decree in February 2008 to dismiss Gagik Jhangiryan from the position of deputy prosecutor general of Armenia. In another decree on the same day, Jhangiryan was stripped of his class rank of first class state advisor of justice.
At that time, the then-prosecutor general Agvan Hovsepyan had requested the president to dismiss Jhangiryan from his position and remove him from the prosecution system. As the basis for his request, he pointed out that Jhangiryan had grossly violated the requirement of the Law on the Prosecution Service, which prohibits prosecutors from engaging in politics. Prior to that, Jhangiryan had announced his support for Levon Ter-Petrosyan and had spoken at a rally organized by him.
The former military prosecutor had filed a lawsuit against Robert Kocharian in 2019, demanding that Kocharian’s decrees be declared null and void by the Administrative Court of Armenia.
