Babken Tunian Shares Important Information on Legalization of Illegal Constructions

Member of Parliament Babken Tunian from the 'My Step' faction has posted on his Facebook page regarding the legalization of illegal constructions.

“Dear compatriots, as you know, starting from January 1 of this year, new real estate cadastre values, which are closer to market values, have come into effect, significantly exceeding the previous values. This has created an issue regarding the legalization of illegal constructions, which concerns thousands of our compatriots.

What is the problem? Many of our compatriots have applied to municipal offices since last year to legalize their constructed illegal buildings. If the decision is positive—that is, if the structure is legalized—then the property owner pays the current cadastre value at that moment. The problem is that despite the applications being made before December 31, 2020, the decisions will be made this year. If the decisions had been made more quickly—before the end of 2020—then they would have paid according to the previous, lower cadastre values. However, in the current situation, in the case of a positive decision, they will have to pay the higher cadastre value that came into effect on January 1.

To relieve our fellow citizens from these difficulties, it has been proposed in the Economic Affairs Permanent Committee of the National Assembly to amend the law on establishing the cadastre assessment procedure close to the market value for the purpose of property taxation. According to this amendment, all individuals who apply for the legalization of illegal constructions by January 31, 2021, will be able to use the previous (lower) cadastre values in the case of a positive decision.

Therefore, those who have already applied for the legalization of illegal constructions can rest assured that regardless of when the decision is made, the previous cadastre values will apply to them without any additional financial burden. I also advise our compatriots with constructions subject to legalization to apply to municipal offices and start the process before January 31, 2021, to avoid unnecessary financial burdens,” wrote Tunian.
