The Court of Appeals of the Republic of Armenia today rejected the prosecutor's appeal against the first instance court's decision to recognize the arrest of my client, Mihran Taron Hakobyan, as unlawful. This was announced by lawyer Mikael Skhimyan on his Facebook page.
“The court has noted, among other numerous violations (lack of reasonable suspicion, imperative circumstances precluding arrest), that the interference with M. Hakobyan's rights guaranteed by Article 5 of the Convention was unlawful. The peculiarity of this decision also lies in the fact that it may have a determinative role in the resolution of the entire criminal case... Presiding Judge Mr. A. Vardanyan,” Skhimyan wrote.
