Court Invalidates Prime Minister's Decision and Orders Reinstatement of Dismissed Inspectorate Deputy Head

The Administrative Court judge Daniel Danielyan has satisfied the lawsuit of Igor Sargsyan, the Deputy Head of the Inspection Body of the Ministry of Environment and Natural Resources, against Prime Minister Nikol Pashinyan. This was reported by Tert.am based on the Judicial Information System.

Igor Sargsyan filed a lawsuit asking the court to annul Prime Minister Nikol Pashinyan's decision dated October 23, 2019, regarding his dismissal from the position of Deputy Head of the Inspection Body of the Ministry of Environment and Natural Resources.

The court noted that the fundamental right to protection of Igor Sargsyan's labor rights was violated and granted his claim. The court has ruled that:

• The Prime Minister of the Republic of Armenia's decision No. 1539-A dated 23.10.2019 regarding the dismissal of Igor Sargsyan from the position of Deputy Head of the Inspection Body of the Ministry of Environment and Natural Resources is declared invalid.
• Prime Minister is obliged to reinstate Igor Sargsyan in his previous role as Deputy Head of the Inspection Body of the Ministry of Environment and Natural Resources.
• Prime Minister is obliged to pay Igor Sargsyan compensation equivalent to his average salary for the entire period of forced absence until the court decision comes into legal force.

The decision will come into legal force one month after its publication and can be appealed to the Court of Appeals of the Republic of Armenia within the same timeframe.
