Samvel Aleksanyan Sues Yerevan Municipality
Former National Assembly member and businessman Samvel Aleksanyan has filed a lawsuit against the Yerevan Municipality. This information has been obtained from the Court Information System.
Aleksanyan is requesting to annul the decision No. 2898-A made by Yerevan Mayor Hayk Marutyan. The lawsuit has been assigned to Administrative Court judge Ruzanna Azroyan.
According to the decision made, based on clause "b" of part 1 of Article 30 of the Law on Administrative Procedures and Administrative Proceedings, it has been established through an investigation within the framework of the administrative proceedings initiated by the Yerevan Municipality that illegal construction works were carried out by citizen Samvel Limindri Aleksanyan on a plot of land owned by the state, located at 102/4 Shiran Street in the Malatia-Sebastia administrative district.
Samvel Aleksanyan has been invited to hearings at the Yerevan Municipality to present his position on the matter. His authorized representative, Grant Margaryan, stated that the buildings in question were constructed back in 2005 and they plan to approach the Yerevan Municipality with a request for their legalization.
According to a letter dated August 19, 2020, from the Architecture and Urban Development Department of the Yerevan Municipality, no application has been submitted or discussed regarding the legalization of structures built without permission by Aleksanyan at the rear of the property located at 102/4 Shiran Street.
It was decided to formally suggest to Aleksanyan to take the initiative to demolish the constructions that were built without authorization and to free the state-owned land from illegal possession. However, no actions have been taken by Aleksanyan towards the demolition of the unauthorized constructions.
As a result, the mayor decided to: 1. Legalize the illegal constructions built on a state-owned land plot at the rear of 102/4 Shiran Street in the Malatia-Sebastia administrative district. 2. Instruct the head of the Malatia-Sebastia administrative district of Yerevan, with the assistance of the urban development and land control department of the Yerevan Municipality and the public order protection service, to demolish the illegally constructed buildings near 102/4 Shiran Street and to free the state-owned land from illegal possession.
