Footballer Gor Malakyan Will Not Be Detained, While Edgar Malakyan Is Already in Custody

The Yerevan Court of General Jurisdiction, headed by Judge David Harutyunyan, rejected the investigator's request to detain footballer Gor Malakyan. This information was provided by Gor Malakyan's lawyer, Gor Mikaelyan. Additionally, the court recognized the decision to arrest Gor Malakyan as unlawful, fulfilling the lawyer’s appeal.

It is noteworthy that Edgar Malakyan, one of the Malakyan brothers, has been detained for one month based on the decision of Judge Harutyun Manukyan. The court partially granted the investigator's petition while simultaneously ruling that the detention was unlawful. The lawyer announced that Edgar Malakyan has already been transferred to the “Aramavir” prison, and they are preparing to appeal the detention decision, challenging both the grounds for the detention and the reasonable suspicion.

According to Gor Mikaelyan, the investigator included almost all the grounds for detention in the petition—risk of escape, concealment, evading responsibility, committing new offenses, and obstructing the investigation. The court considered only the risk of obstructing the investigation as grounded, which the lawyer claims is blatantly unfounded.

It should be noted that the footballer brothers participated in court hearings. Earlier, we reported that an incident occurred on August 30 in Cascade. According to law enforcement agencies, two young men physically assaulted police officers. The mentioned two youngsters had been shouting insults for an extended period, one of them pulled and tore off the epaulet of a police officer. According to the preliminary investigation, during the altercation, one of them punched a police officer in the face, causing bodily injury.

A criminal case has been initiated under Article 316, Part 1 (use of violence against a representative of authority) and Article 258, Part 1 (hooliganism) of the RA Criminal Code, and the footballer brothers were arrested. The young men were charged on the night of September 1-2, and a motion was filed in court for detention as a preventive measure. However, after 72 hours of detention expired, on September 2 at 23:30 and 23:45, the brothers were released. Additionally, the lawyer published photographs of the young men with bodily injuries.
