Prime Minister Pashinyan's Statement on the Creation of the Supreme Court Sparks Turmoil in the Judicial System

According to the daily "Zhoghovurd", Prime Minister Nikol Pashinyan's announcement regarding the creation of the Supreme Court has caused a stir within the judicial system. It is noteworthy that the Prime Minister made this statement during an online press conference on May 16.

“One of the topics of discussion is the complete abolishment of the Constitutional Court and the possibility of having a Supreme Court instead, which is accepted in several countries, because today’s system has, in essence, severed the Constitutional Court from the judicial system, and problems are arising there,” Pashinyan stated during the press conference.

This implies the merger of the Court of Cassation and the Constitutional Court, which has led to confusion within the system. Current judges are unclear about what will happen following the merger of these two bodies and the fate of the employees.

However, there has been an internal discussion in the judicial system, with judges expressing the view that if the issues surrounding the Constitutional Court are resolved, the matter of creating a new body would not arise, and consequently, there would be no dissolution of the Court of Cassation. At the same time, however, the Ministry of Justice has reminded them that regardless of the outcome, an administrative chamber for the Court of Cassation must be established.

The establishment of this chamber is envisaged in the Republic of Armenia's judicial and legal reforms strategy for 2019-2023. Judges are currently anxiously waiting to see whether the Administrative Chamber will be created with the old staff or new personnel. It is noted in the justification that the activity of the Court of Cassation will increase if it has a specialized chamber that examines and resolves cases,” the newspaper writes.
