ECHR Decision Clearly Indicates Article 300.1 Cannot Be Applied in Ongoing Case

The decision of the European Court of Human Rights (ECHR) clearly indicates that Article 300.1 cannot be applied in the ongoing case. This was stated in a post on Facebook by the second President of Armenia, Robert Kocharyan.

“The European Court of Human Rights has published its advisory opinion regarding the case of Robert Kocharyan and others. The ECHR has reaffirmed the standards regarding the prohibition of retroactive effect and the certainty of law. It becomes evident that, as the lawyers and independent experts argued from the very beginning of the case, Article 300.1 cannot be applied in the ongoing case, which existed at the time of the events,” Kocharyan noted.
