Constitutional Court Rejects Robert Kocharian's Application

The Constitutional Court has published a procedural decision on its website (Case No. SDAO-5, dated January 17, 2020) signed by the Court's President Hrayr Tovmasyan. The decision states that Robert Kocharian’s representative requested in an application submitted to the Constitutional Court on December 25, 2019, to recognize that the Law on the Constitutional Court of Armenia, insofar as it does not provide for the possibility of the Court clarifying its decisions, is contrary to the principles of a legal state as set forth in Article 1 of the Constitution, and Article 167, paragraph 1, Article 61, paragraph 1, and Article 63, paragraph 1, rendering it invalid.

The decision also notes, “Considering the proposal from the judicial panel of the Constitutional Court regarding the case of 'on the basis of Robert Kocharian’s application regarding the constitutionality of the Law on the Constitutional Court, to the extent that it does not allow the Court to clarify its decisions,’ the Constitutional Court decided: '… to reject the examination of the case based on Robert Kocharian’s application regarding the constitutionality of the Law on the Constitutional Court, to the extent that it does not provide for the possibility of the Constitutional Court to clarify its decisions.'”
