Protest of Serzh Sargsyan's Lawyer Rejected by Prosecutor's Office
The appeal of A. Makinyan, the lawyer of former President Serzh Sargsyan, to annul the decision to involve him as a defendant in the criminal case being investigated by the RA Special Investigative Service has been rejected by the prosecutor's office, citing that it was groundless.
According to the RA Prosecutor General's Office, the basis for this decision was the consideration of the functional immunity of the former president, indicating that the alleged actions attributed to the third president stem from his official status and activities.
As a result of the study of the materials of the criminal case, the prosecutor concluded that the actions attributed to Serzh Sargsyan in the decision to involve him as a defendant are not derived from the powers vested in him by the Constitution and laws of the RA, and have no relation to the status of the president of the RA. Therefore, the constitutional guarantee of immunity is absent.
