Parliament Approves Bill Granting Disability Status Even 5 Years Post Military Service

The Parliament today approved for the first reading a draft law presented by the government, amending the Law on State Pensions of the Republic of Armenia. The bill proposes to grant disability status even 5 years after military service.

Earlier, on October 10, the Government of Armenia approved this draft during a session. It was presented by the Deputy Minister of Labor and Social Affairs, Gemafin Gasparyan. He stated, “When an injury, deformity, or illness is sustained during military service, and a claim is made to the central military commission in the case of the Ministry of Defense, or to the relevant commission in the case of the Police, a military causal link related to that illness, injury, or deformity is established, which is submitted to our medical-social commission responsible for assigning disability status. However, this status has been granted for five years after discharge from service. We have a case where a person discharged from service in 2000 applied for disability status in 2018, creating a causal connection. Since the law states that after five years we cannot establish a military causal link and can only assign a disability pension based on labor disability, the Constitutional Court decided that this contradicts the Constitution. Therefore, we are removing this regulation,” the Deputy Minister noted.
