«Hraparak». The Government Does Not Take Seriously the Fact that «Sanitek» Has Applied for Arbitration
«Hraparak» newspaper reports that sources close to the government have informed that the notification sent by «Sanitek» to the government and the mayor's office regarding the investment dispute, which states that if the matter cannot be resolved through negotiations, it will proceed to international arbitration, has remained unanswered until now.
According to the newspaper's source, the government does not take seriously the fact that «Sanitek» has filed for arbitration, as the basis of the claim is Article 9 of the agreement on the promotion and mutual protection of capital investments between the Government of the Republic of Armenia and the Government of the Republic of Lebanon. Furthermore, Nicolas Tavil, the director of «Sanitek», being a citizen of the Republic of Armenia, cannot submit such a claim to an international arbitration court. Therefore, the government is confident that «Sanitek» will not be able to succeed in arbitration and sue the Republic of Armenia.
It is said that Nikol Pashinyan had once assured international donors that he guarantees «Sanitek» will not sue us. However, «Sanitek» is confident that there is no such obstacle, as Tavil holds dual citizenship. Moreover, the company has engaged two well-known law firms that are working on the claim, and they are convinced that there is no chance of losing. The claims are expected to be submitted to the Washington arbitration court soon.
