Kocharyan's Defense Files Recusal Motion Against Judge Danibekyan
The defense of Armenia's second president Robert Kocharyan has submitted a recusal motion against Judge Anna Danibekyan of the Yerevan City Court of General Jurisdiction, according to attorney Hovhannes Khudoyan.
According to Khudoyan, Judge Danibekyan, who is presiding over the hearing, does not adhere to the relevant precedents of the European Court of Human Rights or the Constitutional Court of Armenia, although she has previously applied them in her practice. Furthermore, he noted that no decision regarding the change of the measure of restraint is substantiated with proper reasoning or aligned with the factual circumstances of the case, relying instead on quoted normative regulations that do not correspond and do not reflect the positions stated in the conclusive parts of the decisions.
Khudoyan pointed out that Judge Danibekyan holds a biased negative attitude towards the case and specifically towards Robert Kocharyan.
"The presiding judge was previously informed of legal grounds that would allow the application of a bail measure in the presence of obstacles, and later made a decision within this case in which she found that such legal grounds do not exist," Khudoyan emphasized.
Other members of the defense team have joined Khudoyan's motion.
