The Ball is in the Court of the Constitutional Court: Marukyan
The ball is in the court of the Constitutional Court. This was stated by Edmond Marukyan, a member of the National Assembly from the Bright Armenia faction, on his Facebook page.
In the post, it is particularly mentioned: The National Assembly has completed the secret ballot on the decision to appeal to the Constitutional Court regarding the termination of the powers of Constitutional Court judge Hrayr Tovmasyan. The decision has been adopted with 101 out of 132 participating deputies voting in favor of the measure, while 1 voted against it. 2 ballots were considered invalid.
According to Article 83 of the constitutional law on the Constitutional Court, the powers of the Constitutional Court judge shall be suspended from the moment the application regarding the issues specified in this article is accepted for examination until the completion of the trial. During the suspension of the judge's powers, the judge continues to receive their remuneration.
The Constitutional Court judge whose powers are subject to termination is involved in the trial exclusively as a respondent and enjoys the rights provided to the party by this law while bearing its obligations. The trial of issues specified in this article is carried out through oral proceedings. The burden of proof in these cases rests with the applicant party.
If the applicant party refuses the application within the time frame established by this law, and the judge of the Constitutional Court does not object to it within three days, the proceedings of the case are subject to termination. Not later than 30 days from the date of submission of the application, the Constitutional Court shall make any of the following decisions: 1) on the termination of the powers of the Constitutional Court judge; 2) on the rejection of the application.
According to the reasoned procedural decision of the Constitutional Court, the term mentioned in part 11 of this article may be extended, but for no more than 50 days. According to Article 62 of the same law, decisions of the Constitutional Court in cases concerning the termination of the powers of a Constitutional Court judge are adopted by at least 2/3 of the votes of the total number of judges.
