Samvel Adyan and Arsen Torosyan's Testimonies are False, Says Sanasaryan's Defense
The three defendants stated in their testimonies that they had committed certain abuses, and after those testimonies, it was decided to involve the head of the PVT in this process. This was announced today at a press conference by Arsen Sardarayan, the lawyer of the suspended head of the PVT, Davit Sanasaryan.
Sardarayan noted that if some PVT employees had allegedly committed abuses, it still does not mean that the head of the PVT should be held responsible, or that there is a composition of a crime in his actions: “A person must be aware of the actions of their employees, only in this case can a superior be held criminally liable. There is no testimony indicating that Sanasaryan was informed about the schemes of these three individuals. Their testimonies indicate that they composed the internal schemes themselves, while Sanasaryan was completely unaware,” said the defense lawyer, noting that the only thing regarding Sanasaryan is that the defendant in the case, PVT employee Samvel Adyan, wrote in his testimony that he informed Sanasaryan about his business upon being hired.
The defense attorney also pointed out that the Minister of Health, Arsen Torosyan, wrote in his testimony that at the end of 2018, he had a phone conversation with Davit Sanasaryan, stating that a company related to PVT employees participated in the tender for the purchase of hemodialysis, but it presented a good price offer. According to the testimony, Sanasaryan allegedly replied that he had made clarifications and that there were no documentary issues.
According to the lawyer, the testimonies of Samvel Adyan and Arsen Torosyan are false, but even if those testimonies are taken as a basis, then there is no composition of a crime in Sanasaryan's actions. Sardarayan clarified that Samvel Adyan informed Davit Sanasaryan that he had a business, and Sanasaryan replied that legally, there shouldn't be such a thing, implying that the business should be entrusted to fiduciary management, but Adyan understood that he could have a business, which just wouldn’t appear in the documents.
