Clarification of Constitutional Court Judges' Early Retirement Regulation
The refined package of draft laws regarding amendments and supplements to the "Judicial Code" and the "Constitutional Court Law" has been sent to the government, according to the Ministry of Justice.
Based on proposals received during public discussions, several changes have been made to the revised document, which specifically clarifies the regulation on early retirement for members of the Constitutional Court.
It has been suggested that if a member of the Constitutional Court, appointed before the enactment of the 7th chapter of the Constitution, resigns within two months from the date of enactment of the law amending the "Constitutional Court Law," their powers will cease after resignation. Until the age specified in the Constitution for their position is reached, they will receive a pension equal to the official salary and allowances at the time of resignation.
Judges of the Constitutional Court elected after the entry into force of the constitutional law HО-42-N on January 17, 2017, do not benefit from the right specified in the first paragraph of this section.
The draft also includes the establishment of a Judges' Performance Evaluation Commission, which will carry out regular and extraordinary evaluations of judges.
Additionally, it should be noted that the requirement for the suspension of powers in case of criminal prosecution against a judge of the Constitutional Court has been removed from the revised version of the draft.
