NSS Rejects Criminal Case Launch Based on David Grigoryan’s Lawyer's Complaint
The National Security Service (NSS) has rejected the launch of a criminal case based on a complaint from David Grigoryan's lawyer. This was reported by Gor Abrahamyan, an advisor to the Attorney General of Armenia.
“I find it necessary to note the following regarding the position expressed by the Supreme Judicial Council regarding the legality of the actions of sealing the door of the judge's office and its protection by police. On July 17, 2019, the acting Attorney General sent a request to the NSS related to the report submitted the previous day by the representative of the judge’s interests at the police, in order to verify the circumstances mentioned therein.
The lawyer contested the legality of sealing the door of Judge David Grigoryan's office, arguing that it violated the inviolability of his residence, as the office is equated to a residence according to the law.
As a result of the preparatory materials, a decision was made within the investigative department of the NSS to reject the initiation of a criminal case on the basis of the absence of the corpus delicti envisaged in Articles 147 and 308 of the Criminal Code of Armenia.
I find it necessary to emphasize that in light of the Supreme Judicial Council's statement, considering that this decision may be appealed to a superior prosecutor, we refrain from making any comments or expressing a position on this matter at this time.
As for the fact mentioned in the Supreme Judicial Council's statement that a request has been submitted to take the appropriate actions stipulated by law, the Prosecutor’s Office has not yet received such a document, and we are currently not informed about what it pertains to,” Abrahamyan wrote.
