We Demand the Grounds for the Wiretaps: Attorney of Bagrat Srbuzyan
Bagrat Srbuzyan's attorney, Hovhannes Khudoyan, has requested the court to present information regarding the legal grounds under which the wiretaps on Bagrat Srbuzyan and others were conducted.
Khudoyan submitted the relevant request at the Yerevan Court of General Jurisdiction during a hearing presided over by Judge Karen Farhoyan. According to the attorney, the entire case is illegal. He emphasized that if law enforcement agencies lacked the legal grounds to initiate proceedings and wiretap individuals, then all subsequent actions are also illegal.
“We are raising a very simple question: was the initiation of the case legal? I find it incomprehensible that the public prosecutor believes that evidence should first be examined and then, at the end, the grounds should be addressed. Naturally, if law enforcement does not provide the relevant data to the court, the absence of such information renders the examination of the case utterly meaningless, and no evidence can be investigated. The working hours of the court, the public prosecutor, and the defenders, as well as the right to a reasonable time frame for the examination of the case, are directly dependent on whether this case can be continued. The stance on this issue is clear: whether the data was sufficient or not. From a legal standpoint, the approach of public prosecutors is incomprehensible, whereas from the perspective of political persecution, it is fully understandable,” Khudoyan stated.
