Partial Approach or Court Proceedings at Whim: «Egalite» LLC vs. Public Commission

The Administrative Court of Appeal held a session chaired by Judges Rafik Khandanyan, Mikayel Melkumyan, and Alexandra Harutyunyan in the case of «Egalite» LLC against the Public Television and Radio Commission.

It is noteworthy that «Egalite» LLC is contesting the results of the competition for the frequency 106.9 held by the Public Television and Radio Commission. This frequency was used for broadcasting Radio Jazz FM.

At the start of the hearing, the representative of «Egalite», lawyer Tigran Muradyan, filed a motion for the recusal of Judges Khandanyan, Melkumyan, and Harutyunyan. The reason given for this was that the court had scheduled the hearing merely two months after the filing of the lawsuit, despite the fact that due to heavy caseloads, the appellate court has been examining claims no sooner than a year.

What it appears is that, in the case against the Public Television and Radio Commission, either the court has exhibited a partial approach or claims that are not investigated within a year are simply ignored and taken up at whims.

Despite considering the recusal motion, the court ultimately rejected it. It is remarkable that the three judges of the appellate court rejected the recusal request with literally the same reasoning.
