Decision of the Judge Transferred to Samuel Karapetyan's Defenders

Businessman Samuel Karapetyan's defenders have received the decision from the Appeal Court issued by Judge Armen Danielyan. This was announced by Samuel Karapetyan's defense council.

The decision states that Danielyan, without providing any legal analysis or justification, merely noted in the judicial act based on an 'objective observer' that he found the conclusions of the first instance court to be lawful.

"We would like to quote a passage from the mentioned judicial act regarding the refutation of the reasonable suspicion related to the act attributed to Samuel Karapetyan: 'The Court of Appeal finds that the raised issues are much deeper... regarding which it is impossible to address from the perspective of reasonable suspicion in this case...'. In other words, according to the court, since the raised issues directed at refuting reasonable suspicion are 'deep,' the absence of reasonable suspicion is not recorded. Instead, the judicial act remains unchanged, without any substantive legal argumentation being presented," the statement said.

It is noted that the case file does not contain any reference to Article 422 of the Criminal Code or to decisions from the Constitutional Court and the Supreme Court that contradict the accusations. The court, having not addressed these at all, also did not touch upon the widely discussed issue that the prosecutor's report could not be considered within the framework of reasonable suspicion, especially since that report was not even attached to the materials.

“From a legal perspective, this is a clear indicator of the absence of justice or mockery of the law, indicating that an obviously dismissible judge, who rejected the recusal motion, refers to an 'objective observer'... The justifications provided in the judicial act concerning why Samuel Karapetyan should remain in custody until June 18, 2025, consist of just two pages, thus minimally complying with the requirements for the substantiation of a judicial act,” the lawyers added.
