Fraudulent Theft of 45,000 USD from a Citizen
The prosecutor confirmed the indictment on June 9, 2023, regarding the violated rights of citizen M.S. and submitted the materials of the case to the First Instance General Jurisdiction Court.
It is noteworthy that citizen M.S. declared a hunger strike in May 2022 near the General Prosecutor's Office, protesting injustice and protectionism, requesting measures to restore his violated rights.
The prosecution took measures to identify the person who allegedly committed a crime examined for a prolonged period, and public criminal prosecution was initiated.
During the pre-trial investigation of the criminal case, it was revealed that M.K., intentionally distorting and providing falsified information that does not actually exist, as well as lacking any intention or actual ability to establish or conduct business, fraudulently appropriated 21 million 375 thousand drams equivalent to 45,000 US dollars belonging to M.S. on July 11, 2019.
Additionally, M.K. by deceitfully abusing the trust of citizen V.T., lacking any opportunity to acquire tobacco for entrepreneurial purposes under discount or any other preferential terms, fraudulently appropriated a total of 8 million 450 thousand drams from V.T. in August 2019 under the pretext of making an investment.
In another incident, M.K. reached an agreement with citizen H.T. between August and September 2019 with the latter’s assistance to illegally acquire and sell particularly large quantities of narcotic substances. By M.K.'s instruction, H.T. acquired particularly large quantities of methamphetamine from other individuals and transferred it to individuals indicated by M.K. until May 2020.
On June 6, 2023, the materials of the criminal case were received at the Prosecutor General’s Office regarding the charges against M.K. for Article 255, part 3, point 3 of the Criminal Code (large-scale fraud) (2 episodes), and Article 393, part 3, point 2 (illegal circulation, sale of particularly large quantities of narcotic substances and psychotropic substances, their preparations or equivalent substances).
