Citizen's Land Plot Registered as Donation in Former MP's Wife's Name After Sale

After the sale of a land plot that was not subject to alienation, it has been registered as a donation in the name of former MP Mher Sederakyan's wife. This information was reported by the Public Relations Department of the Prosecutor's Office.

On July 1, 2003, by the decision of Yerevan Mayor R.N., a land plot located at 78/3 Azatamartikneri Street was alienated to citizen M.P. at a price significantly below market value—14 million 646 thousand 180 drams—while the plot was included in the list of land plots that are not subject to alienation as per Article 60 of the Land Code.

The process of alienation of the building at 78/3 Azatamartikneri Street has been investigated within the framework of the lawsuit for the protection of state (community) interests at the Prosecutor's Office of the Center and Norq-Marash administrative districts in Yerevan. The investigation revealed that, based on the outcomes of an auction conducted on June 27, 2003, the land plot at 78/3 Azatamartikneri Street was granted to citizen M.P. as a lease for the construction of a playground and an outdoor café on December 26, 2003. The plot is located within the area of the Erebuni Children's Park, and by a decision of the Government on December 15, 2005, it was included in the list of land plots that are not subject to alienation as per Article 60 of the Land Code.

On January 17, 2008, the Deputy Mayor of Yerevan, K.D., provided an evidently false expert conclusion stating that the land plot at 78/3 Azatamartikneri Street was not included in the list of restrictions under Article 60 of the Land Code. Based on this conclusion, the responsible officials of the territorial division of the Cadastre Committee granted M.P. a certificate of property rights registration. Subsequently, the land plot at 78/3 Azatamartikneri Street was registered as a donation in the name of Sh.A., the wife of former MP M.S., who sold the non-alienable land plot for 150 thousand USD to a legal entity.

In the criminal case being investigated by the third division of the Investigative Administration of Yerevan's Center and Norq-Marash administrative districts, it has been established that K.D., the Deputy Mayor of Yerevan, misused his official powers in the aforementioned process. On December 27, 2021, a decision was made to not initiate criminal prosecution against K.D. due to the expiration of the statute of limitations.

On June 6, 2023, the Prosecutor's Office of the Center and Norq-Marash administrative districts filed a lawsuit in the Administrative Court demanding the annulment of the Yerevan Mayor's decision of July 1, 2003, along with its consequences, including the cancellation of the state registrations of rights and entries in the register.
