Land Plot Privately Transferred in 'Fizgorodok': Former Cadastre Committee Official Faces Public Prosecution
On March 17, 2023, the prosecutor initiated public criminal prosecution against R.H., the former head of the 'Davtashen' territorial division of the State Cadastre Committee, and citizen T.A. under the third part of point 3 of Article 255 of the Criminal Code of Armenia (especially large-scale fraud).
R.H., from October 1, 2004 to October 1, 2006, while holding the position of head of the real estate state register in the 'Davtashen' territorial division of the State Property Cadastre Committee, allegedly conspired with T.A. and, with the assistance of G.S., an employee of the same division, disregarded the decision No. 05-931 of the Court of Cassation of Armenia dated March 29, 2005, to register the private ownership rights of citizen T.A. on a land plot of 1976.1 square meters, along with a basement of 50.8 square meters, located adjacent to Alikhanyan Brothers Street in Yerevan (commonly known as the 'Fizgorodok' neighborhood).
Subsequently, on April 28, 2006, the property was sold to A.B., and on October 13, 2006, it was transferred to 'Ratko' LLC. All three instances of registering property rights on the land plot of 1976.1 square meters and the basement of 50.8 square meters were conducted by R.H., the head of the real estate state register in the 'Davtashen' territorial division of the State Property Cadastre Committee.
As a result of R.H.'s actions, the state suffered particularly large property damage amounting to 117 million AMD. On March 17, 2023, the decision to initiate public criminal prosecution by the supervising prosecutor was sent to the investigator conducting the pre-trial investigation to present charges.
Note: The accused in the crime is considered innocent until proven guilty by a court judgment that has entered into legal force in accordance with the established procedure of the Criminal Procedure Code.
