Sedrak Kocharyan Sues Ministry of Finance Seeking Compensation
Sedrak Kocharyan, the son of Armenia's second President Robert Kocharyan, has filed a lawsuit against the Republic of Armenia, represented by the Ministry of Finance. This information was reported by Tert.am, referencing the Judicial Information System.
Sedrak Kocharyan is demanding compensation for both non-material and material damages. He asserts that his right to a fair trial was violated due to the disregard for the compulsory nature of the Yerevan City Court concerning his property, and that the prolonged consideration of detention requests infringed upon his right to a timely trial. Additionally, he claims there was a failure to ensure access to the court in the criminal case, as well as an absence of legal mechanisms and procedures for appealing the factual rejection of that request in the appellate court, which has led to a significant breach of his fundamental ownership rights.
Sedrak Kocharyan is demanding 2 million AMD from the Republic of Armenia (through the Ministry of Finance) as compensation for non-material damages for each established violation of his fundamental rights, totaling 8 million AMD. Furthermore, he is seeking 3,312,400 AMD in compensation for material damages.
He also requests the recovery of court costs from the Republic of Armenia (through the Ministry of Finance), including a previously paid state fee of 339,372 AMD, as well as payment for the attorney's fees incurred and to be incurred.
Sedrak Kocharyan's lawsuit was accepted for processing on June 21, 2022, and is being examined by Judge Zhanna Asatryan.
