Regulation Authority Suspends Licenses of 'ARMNIUZ' and 'RADIO 107 FM' for Five Days
Today, February 12, an extraordinary session was convened at the Television and Radio Commission, with the agenda focused on administrative actions concerning 'ARMNIUZ' LLC and 'RADIO 107 FM' LLC. This was reported by the Commission.
Presenting the agenda items, it was noted that during the monitoring of the audiovisual program 'ARMNIUZ' LLC and the audio media service 'RADIO 107 FM' LLC, violations were discovered. Specifically, it was found that as of February 11, 2022, at 00:01, the broadcasters failed to ensure the broadcasting of audiovisual programs for more than 24 hours.
Additionally, despite the founders of 'Quad Media' announcing the cessation of their activities, they have not officially notified the Commission in writing regarding their decision to halt the licenses of 'ARMNIUZ' LLC and 'RADIO 107 FM' LLC, either in their issued statement or separately.
According to Article 58, part 3, clause 5 of the Law on Audiovisual Media, the license can be suspended if an application is submitted to that effect. Considering this circumstance, the Commission initiated administrative proceedings against the broadcasters on February 12, 2022, in accordance with the Law on Administrative Principles and Administrative Proceedings.
As a result of a comprehensive examination of the administrative proceedings, the Commission recorded that the broadcasters failed to ensure the broadcast of audiovisual and audio programs for a continuous 24 hours without any justified reason, and they did not present any justification for the cessation of broadcasts.
Based on Article 58, part 1, clause 4 of the Law on Audiovisual Media, the authorization or license of a broadcaster shall be suspended if the licensed broadcaster fails to ensure the broadcasting of audiovisual programs for a continuous 24 hours without any reasonable cause.
In light of the above and guided by Article 55, part 1, clause 3; Article 58, part 1, clause 4 of the Law on Audiovisual Media; Article 34, part 1; and Article 36, part 1, clause 12 of the Law on Licensing, the Television and Radio Commission decided to impose an administrative penalty by suspending the licenses of 'ARMNIUZ' LLC and 'RADIO 107 FM' LLC for a period of five days.
