Hearing on Bail Request for Detained Soldier Postponed

On November 26, Aram Aghasyan, a conscript detained after his return from captivity, had his hearing regarding the request to replace his detention with bail postponed today. This was reported by Factinfo.

It is reminded that after being captured, Aghasyan was transported by helicopter from Ganja to Baku for surgery, as his condition was critical. Following his return on November 26, Aghasyan was moved to Muratsan Hospital, where he received medical care for 10 days before being detained by Armenian law enforcement.

While in the hospital, he was questioned as a victim. On December 6, he was arrested in connection with a criminal case being investigated by the Investigative Committee, and the prosecuting body filed charges and a motion for detention, which was approved by Yerevan Court of General Jurisdiction Judge David Arghamanyan.

Aghasyan has been charged under part 3 of Article 365 of the RA Criminal Code, that is, violating the rules of combat duty or performing combat service, which led to serious consequences.

A motion has been filed against the detention order, which was rejected by the appellate criminal court judge Armen Danielyan. Just before the New Year, the prosecuting body submitted a motion to the court to extend the detention by another two months, which was granted on December 30.

The defense attorney submitted a motion to the court to replace Aghasyan's detention with bail, proposing the amount of 500,000 AMD, considering Aghasyan's family's social conditions. The defense based their motion on the conclusion of the preliminary investigation and the deterioration of Aghasyan's health condition.

Specifically, with the conclusion of the preliminary investigation, the likelihood of obstructing the trial has significantly decreased, and regarding Aghasyan's health condition, without proper medical care, there is a risk of amputation of his leg.

According to Factinfo, the hearing to release Aghasyan on bail, presided by Judge David Arghamanyan, was supposed to take place today but has been postponed due to the need to present documents regarding Aghasyan's health condition. Attorney Ara Karapetyan informed us that Aghasyan has undergone examinations in the last three days; however, the diagnosis has been conveyed based on the doctors' statements. The court postponed the hearing to allow the defense to present documented information regarding Aghasyan's health status.

The lawyer also noted that Aram Aghasyan was not present at the court session because he is unable to move, as it is contraindicated for him.
