Who Should Pay for PCR Tests? Anahit Avanesyan on the Constitutional Court's Decision

The Constitutional Court has recognized the order of the Minister of Health as constitutional. All of its requirements, except for the phrase "at their own expense," are in line with the Constitution. These requirements will remain in effect; we have no changes to make.

In a conversation with reporters, Health Minister Anahit Avanesyan addressed the Constitutional Court's decision that deemed part of the Minister’s order on PCR tests unconstitutional.

Regarding the "at their own expense" clause, which was ruled unconstitutional, the minister noted that this wording will be removed. "Considering that it is not mandatory for a citizen to take the test at their own expense, and it can be covered by another person who wishes to pay for the test on their behalf, we cannot impose such a restriction, which is lawful. A friend or relative can also pay for the test on behalf of the citizen," Avanesyan said and emphasized that the Constitutional Court’s decision does not mention the state or employer covering the costs of testing.

"Clearly, all expenses that are not covered by the state budget are carried out on a private basis, either by citizens or other individuals," stated Anahit Avanesyan.

The minister also informed that proceedings have been initiated regarding PCR tests, as there have been sudden changes in pricing policies at laboratories conducting PCR testing. The Ministry of Health will investigate this and determine how objective and justified these changes are. "During the proceedings, it will become clear whether the actions of the laboratories were lawful or not," she added.
