All Requirements of the Minister's Order Remain in Effect: Ministry of Health
The Constitutional Court has published its decision regarding the compliance of Article 20.1, Part 3, Article 22, Paragraph 3 of the Law on Ensuring Sanitary and Epidemiological Safety of the Population of the Republic of Armenia, and Minister of Health's Order No. 65-N dated August 20, 2021, with the Constitution.
The decision of the Ministry of Health concerning the requirement for PCR testing has been deemed constitutional, as it stems from the public health interest. However, the following phrase in all the appendices of the minister's order was declared unconstitutional: 'the employee performs it at their own expense.'
Nevertheless, considering that the state does not guarantee PCR testing under privileged and free conditions, employees must still undergo testing. Therefore, the Minister of Health's order has been recognized as constitutional, and all requirements remain in effect. Only the aforementioned wording has been recognized as unconstitutional.
