Having Numerous Evidence, We Lost: Who is Responsible for the Situation?

According to the newspaper 'Zhoghovurd',

“About a month ago, pro-government figures spread information on the internet that Armenia had filed a crushing lawsuit against Azerbaijan at the International Court of Justice of the United Nations. We were all breathlessly waiting for the final outcome, which should surely have marked the beginning of punitive actions against Azerbaijan's atrocities. However, we were disappointed once again. The International Court of Justice in The Hague deemed it necessary for both parties—Armenia and Azerbaijan—to undertake additional measures.

Consequently, Azerbaijan is required to take measures to prevent the incitement of racial hatred against Armenians. 'In accordance with the obligations taken under the international convention for the elimination of all forms of racial discrimination, Azerbaijan must protect detainees from violence and harm... and must undertake all necessary measures to prevent the incitement of racial hatred and discrimination against ethnic Armenians, including by officials,' stated the court's president, Joan Donohue.

The same judge called on Armenia to take steps to prevent the incitement of racial hatred against Azerbaijanis, adding, 'Armenia, in accordance with its obligations related to the elimination of all forms of racial discrimination under the international convention, must undertake necessary steps to prevent the incitement and unleashing of racial hatred against Azerbaijanis, including by organizations and individuals within its territory,' said the judge while revealing Baku's lawsuit against Yerevan for violating the convention regarding the elimination of all forms of racial discrimination.

So, what does this result in? Since November 9, Armenia has returned all prisoners of war, while Azerbaijan not only keeps them but also tortures and tries our soldiers, selectively returning them according to its convenience. Nevertheless, the Court of the International Court of Justice equates us with Azerbaijan and applies precautionary measures against Armenia as well.

The question remains: who is responsible for this situation within our country? The group led by Yegishe Kirakosyan, Armenia's permanent representative to the European Court of Human Rights, should not only have filed a lawsuit against Baku but also justified and defended the case. Furthermore, the Chief Prosecutor of Armenia, Artur Davtyan, who periodically announces that a criminal case has been initiated regarding various Azerbaijani atrocities and that these will be used in international courts to protect the rights of citizens, should have been able to gather such evidence against Azerbaijan in the context of criminal cases that would be undeniable. However, it turns out that despite having so much evidence, Armenia finds itself in a vulnerable situation. Either Yegishe Kirakosyan’s group failed to adequately present our arguments as irrefutable evidence, or the evidence gathered by the prosecutor’s office was insufficient (as has been the case with many high-profile criminal cases, which often end up as a bubble), or the representatives of the Armenian government have been guided by Alen Simonyan’s logic that there are no prisoners.

In short, having numerous pieces of evidence, we lose in court again (at this stage, in fact). Awaiting the end of the trial.”
