The Prosecutor Has Been Addressed Regarding the Judge Who Decided to Arrest the MP
The defense team has approached the Prosecutor General of Armenia regarding the judge who decided to arrest Arthur Sarkisyan, a deputy from the "Hayastan" faction of the National Assembly and former mayor of Sisian, filing a criminal complaint. This information was published on the Facebook page of Sarkisyan's lawyer, Emin Khachatryan.
“Previously, we reported that on November 15, 2021, Judge Armen Danielyan of the RA Court of Appeal held an urgent court session without properly notifying the defense and in their absence, to examine the prosecutor's appeal against the bail chosen as a preventive measure for MP Arthur Sarkisyan, and canceled the decision of the first-instance court of Syunik region dated October 14, 2021,” Khachatryan stated.
“We have now submitted appropriate motions to the Ethics and Disciplinary Issues Commission of the Supreme Judicial Council of Armenia and the Minister of Justice so that disciplinary proceedings can be initiated against Judge Armen Danielyan of the RA Court of Appeal. We have also filed a complaint with the RA Human Rights Defender, and have submitted a criminal report regarding the evident unlawful court act of Judge Armen Danielyan,” he added.
“During my legal career, I have never undertaken such an initiative, but this is a case where the essence of justice has been fundamentally disrupted by the clearly unfounded and unlawful decision made by Judge Armen Danielyan, violating several fundamental rights of our client, as well as important principles of criminal law and procedure. As lawyers for Arthur Sarkisyan, as well as members of the Chamber of Advocates of Armenia, we find such behavior by a judge unacceptable,” Khachatryan emphasized.
“Recently, the Minister of Justice has spoken extensively in various addresses about subjecting unjust judges who do not fulfill justice to vetting. In my opinion, this initiative is a good opportunity for the Minister of Justice to prove the sincerity of his statements,” he concluded.
