Court Rules in Favor of Lydian Armenia

Lydian Armenia informs that on July 29, the Court of Appeal of Armenia rejected the appeal lodged by the Armenian Environmental and Mining Inspection Body. The Administrative Court had previously declared invalid the Act No. 30 issued by the Inspection Body on August 24, 2018, as a result of checks in Amulsar, confirming 8 out of 10 violations, including the unlawful mining activities in the Amulsar area.

The court also invalidated the decision No. 30/1 made by the former head of the Inspection Body, Arthur Grigoryan, which rejected Lydian Armenia's administrative appeal. The Administrative Court found that prior to his appointment as the head of the Inspection Body, Arthur Grigoryan had been actively involved in actions against the Amulsar project, raising reasonable doubts about his impartiality at the time of rejecting Lydian Armenia's appeal as an official of the competent authority.

This ruling from the Court of Appeal constitutes another favorable judicial act for Lydian Armenia, noting the violation of the company's rights by a state body, as well as the biased behavior exhibited towards the company by its former head, Arthur Grigoryan. Thus, the Court of Appeal upheld the previously issued ruling of the Administrative Court.

The ruling of the Court of Appeal enters into legal force one month after its publication and can be appealed to the Supreme Court of Armenia within the same time frame.
