Constitutional Court Deems the Law on Higher Education and Science and Dozens of Other Laws Unconstitutional
The Constitutional Court has recognized the Law on Higher Education and Science, adopted by the National Assembly of Armenia on March 24, 2021, and a number of other laws as unconstitutional.
Specifically, based on the results of the case examination and guided by points 1 of Article 168, point 4 of part 1 of Article 169, and Article 170 of the Constitution, as well as Articles 63, 64, and 73 of the constitutional law on the Constitutional Court, the Court has decided to declare the following laws unconstitutional:
- The Law on Higher Education and Science
- Amendments and additions to the Law on Education
- Amendment to the Law on Foundations
- Amendments to the Law on State Non-Commercial Organizations
- Amendments and additions to the Law on Licensing
- Amendments and additions to the Law on State Duties
- Amendments to the Tax Code of the Republic of Armenia
- Amendments to the Criminal Enforcement Code of the Republic of Armenia
- Amendments to the Law on Medical Care and Service for the Population
- Amendments to the Law on Ecological Education and Training
- Amendments to the Law on Energy Saving and Renewable Energy
- Amendments to the Law on Emergency Services
- Amendments and additions to the Law on Service in the Police
- Amendments to the Law on the Approval of the Disciplinary Code of the Police of the Republic of Armenia
- Amendments to the Law on Service in the National Security Authorities
- Amendments to the Law on the Status of Military Units and Institutions
- Amendments and additions to the Law on Military Service and Service Members' Status
- Amendments to the Law on Medicines
- Amendments to the Law on State Awards and Honorary Titles of the Republic of Armenia
- Amendments to the Law on Notaries
- Amendments and additions to the Law on State Pensions
- Amendments to the Law on Language
- Amendments to the Law on Procurement
The Constitutional Court has found the 3rd and 4th parts of Article 27 of the Law on Higher Education and Science to be inconsistent with Article 38, part 3 of the Constitution.
In accordance with part 2 of Article 170 of the Constitution, this decision is final and comes into force from the time of its publication. The details of the decision have been published on the official website of the Constitutional Court.
