Deputy Colonel Not Detained in Case of 62 Shirak Soldiers' Captivity
Following the end of the war, Deputy Colonel Arsen Ghazaryan will not be detained in connection with the criminal case regarding the capture of 62 Armenian servicemen from the villages of Hin Tagher and Khtsaberd in the Hadrut region, which fell under Azerbaijani control.
The Court of General Jurisdiction of Yerevan, presided over by Judge Artush Gabrielyan, rejected the investigator's request to select detention as a preventive measure against Ghazaryan. Ghazaryan's lawyer Vahan Hovhannisyan told “Factinfo” that the court ruling did not even address the grounds and conditions for detention.
“The court stated that the regulations and conditions of a non-custodial preventive measure had not been violated previously, and in such circumstances, there is no need to revoke it and apply detention as a preventive measure,” Hovhannisyan noted.
In other words, the court found that the prosecutor's request for detention was unjustified. As previously reported, Deputy Colonel Arsen Ghazaryan faces charges under parts 7, 3, and 3 of Article 361, Article 356, Article 376, and Article 380 of the RA Criminal Code for allegedly leaving service voluntarily during a state of war, failing to comply with an order under wartime conditions, showing negligence toward service during wartime, and voluntarily abandoning the battlefield or refusing to engage with a weapon during combat.
