The ECHR to Apply Interim Measures According to the Armenian Government’s Request and Calls on Both States to Fulfill Their Convention Obligations

The European Court of Human Rights (ECHR) has decided to apply interim measures based on the request of the Armenian government on September 29. This was reported by the Armenian representative at the ECHR.

In particular, considering the situation that could lead to the most serious violations of the Convention, the ECHR, composed of a chamber of 7 judges, has decided to apply Rule 39 of the Court’s regulations. To prevent such violations and in accordance with Rule 39, the ECHR calls on both Azerbaijan and Armenia to refrain from actions, particularly military operations, that may result in violations of the conventional rights of the civilian population, including endangering their lives and health.

The ECHR also urges Azerbaijan and Armenia to fulfill their convention obligations, especially regarding Article 2 (Right to Life) and Article 3 (Prohibition of Torture and Inhuman or Degrading Treatment or Punishment) of the Convention. Both High Contracting Parties must provide information on the implementation of their obligations to the European Court as soon as possible.
