From Now On, Citizens Do Not Need to Visit the Cadastre After Notarization: Government's New Decision

The government approved a package of amendments to the law on state registration of property rights and related laws during its meeting today, June 11. The issue was presented by Minister of Justice Rustam Badasyan. He noted that the current law does not allow for the respect of the 30-day deadline for state registration after notarized transactions.

“In other words, there is no justification for a notary to excuse the violation of this deadline due to circumstances beyond their control. This has been recognized as unconstitutional, which is why we propose to establish grounds on which a person can submit a request to have the deadline excused, and this will be deemed acceptable by the cadastre for state registration,” he said.

“Furthermore, until now, while a notary could send the notarized transaction to the cadastre, there was no clear obligation to do so. We are now establishing that this becomes their responsibility. This means individuals will not need to go to the cadastre to make a separate registration when conducting the transaction with the notary. However, if someone prefers not to do it at the notary's office, they can still apply to the cadastre separately.

It is also established that no additional fee will be charged for this. Thus, with this amendment, after the transaction, individuals do not need to visit the cadastre and submit another application; they only need to go and pick up their property certificate.”
