Procedure for Reporting Transport Violations via Mobile Application to be Presented
Vahé Ghazaryan, the head of the police, will present a draft decision at tomorrow's government meeting, which aims to establish that: 1) a maximum of 3 electronic reports can be submitted monthly and a maximum of 30 annually by the same person for the same transport vehicle, registered in a specially developed state-owned system (hereinafter referred to as the mobile application); 2) violations of the Administrative Offenses Code of the Republic of Armenia can be recorded via the mobile application only in cases prescribed by law under Article 43.1, Part 7, Article 123.3, regarding riding without fastening a helmet or without a helmet altogether, as well as for transporting passengers without a helmet or with an unfastened helmet, the violations outlined in Article 124, Parts 2, 9, 14, 15, 17, 18, 21, 26, 27, and Article 124.3, as reported by iravaban.net.
The decision will come into force on the day the mobile application is launched but not later than January 1, 2021.
The justification indicates that currently, administrative offenses for not complying with traffic rules (related to traffic safety legislation) are recorded only in Yerevan (with exceptions for cases exceeding the maximum permitted speed), and not across all areas, resulting in a significant number of violations remaining latent. These violations cannot be fully anticipated, prevented, or detected, including by the traffic police patrols. The issue is even more concerning in other settlements of the Republic of Armenia, as the number of traffic police patrols is insufficient to simultaneously and continuously ensure monitoring of compliance with traffic safety legislation across urban areas, inter-state, provincial, and other roads.
Information about fines imposed as a result of administrative violations detected by the Road Patrol Service of the Traffic Police between 2017-2019 is provided below. According to Article 7.3 of the law, the maximum number of electronic reports that can be sent by the same person regarding the same vehicle via the mobile application will be determined by the government of the Republic of Armenia. To prevent the potential misuse of the application for malicious or interpersonal purposes, the draft establishes that the same person cannot submit more than 3 electronic reports for the same vehicle per month and 30 per year.
Simultaneously, the types of violations defined by the Administrative Offenses Code of the Republic of Armenia that frequently occur in practice and pose a significant public risk are established for detection through the mobile application's capabilities.
