The Attorney General's Advisor Comments on Gurgen Khachatryan's Defenders' Statement

The chairman of the board of directors of Ucom LLC, Gurgen Khachatryan's defense team may file a report about a crime if they have observed violations of their client's rights or procedural procedures.

This was stated by Gorr Abrahamyan, the advisor to the Attorney General of Armenia, in response to a question from Armenpress, commenting on the statement made by Gurgen Khachatryan's defenders.

“To be honest, I do not want to comment on the defense team's statement regarding this, considering it a part of their defensive strategy. However, if they have seen violations of their client’s rights or procedural processes in the actions of the investigator, or believe that a criminal offense has occurred and they have been coerced into taking certain actions, then, while remaining within the framework of the criminal proceedings and refraining from influencing public opinion, they could utilize their opportunity to appeal the procedural decisions. In that case, the prosecution, upon reviewing the provided grounds, will express a corresponding position. Alternatively, they could simply report a crime, which, as far as I know, has not been done,” said Abrahamyan.

According to the Attorney General's advisor, the fact that Khachatryan’s defenders are making statements questioning the legality of the investigative body’s actions, considering potentially predictable developments, does not mean that the actions of the preliminary investigation body are indeed such or could be such.

“The application of a preventive measure is based on the factual circumstances obtained in the criminal case, taking into account the possible predictable behavior of the accused within the proceedings. Otherwise, by making preliminary statements, one can always shape public opinion with a manipulative effect regarding the legality of the actions of law enforcement agencies,” Abrahamyan noted.

The Attorney General's advisor stated that information about the circumstances obtained during the investigation and the grounds under which charges have been presented and the request to choose pre-trial detention as a preventive measure will also be published soon.
