Appeals Court Rejects Kocharyan's Lawyer's Motion for Reconsideration of Judicial Act

The Appeals Criminal Court judge Tigran Sahakyan has rejected the motion filed by former President of Armenia Robert Kocharyan's lawyer, Hayk Alumyann, to initiate reconsideration of a judicial act based on new circumstances.

It is noteworthy that the lawyer had appealed to the Appeals Court to reconsider the decision made by the First Instance Court on September 20, 2019, to annul and amend it, to lift the detention ordered for Robert Kocharyan, and to release him from custody. Alternatively, he sought to recognize the application of bail as permissible and to render a decision regarding Robert Kocharyan's release on bail.

In an interview with NEWS.am, Hayk Alumyann stated that the contested judicial act is empowered to initiate proceedings based on new circumstances by the Court of Cassation of the Republic of Armenia. “We will file another appeal with the Cassation Court to see what they say; I don’t see any problem. If the Cassation Court suddenly says no, that it should have been the Appeals Court that reviewed it and not the Cassation Court, then we will apply to the Council of Justice to understand why this judge artificially avoided reviewing our appeal,” he noted.
