Statement of Kocharian's Legal Team Regarding the Constitutional Court Decision

The legal team of the second President of Armenia, Robert Kocharian, has issued a statement regarding the decision of the Constitutional Court.

“The legal team of the second President of Armenia, Robert Kocharian, filed an application with the Constitutional Court to examine the constitutionality of the decision of the Court of Cassation regarding the detention of R. Kocharian without examining it. Specifically, this concerns Article 407 of the Criminal Procedure Code of Armenia in conjunction with Article 414.2, and the question of its compliance with the Constitution. However, the Constitutional Court has decided today to reject the examination of the case.

This question pertains to practical application rather than the classical sense of criminal procedural legislation. The team believes that this issue has universal significance and thus it is necessary to raise the question regarding it.

We will provide a more detailed response to this issue after familiarizing ourselves with the procedural decision of the Constitutional Court within the established timeframes and making it public.”
