Drivers Will Appeal the Points System in Two Stages, Cases Will Remain in Courts

It is beyond dispute that a filter must be introduced into the administrative appeal process and that administrative courts must be relieved. This was stated today, September 16, at the meeting of the National Assembly by MP Armen Khachatryan from the 'My Step' faction.

It is worth noting that the proposed bill suggests that the administrative body considering the appeals should provide their conclusion not in 30 days, but in 15 days, after which a citizen, if they disagree, may appeal to the court.

Armen Khachatryan pointed out that indeed, this legislation may slightly relieve the administrative courts; however, when the points system for traffic fines comes into effect at the beginning of next year, a significant increase in judicial appeals is expected. "As much as we are relieving the system now, I predict that the appeals in the administrative court will increase doubly, and essentially, the issue will remain unresolved. There will be more cases in the courts at that time than there are today," he said.

The MP added that it is also necessary to introduce regulations regarding state duties. "Under the points system, appeals will be filed in an administrative process, and if rejected, they will go to court. What is preventing a two-stage appeal process? Nothing. This will overload both the administrative body and the court. As a result, cases will remain in administrative courts for years and will be considered, and the points system will not properly come into force. I also propose changes regarding state duties, that if a person appeals to the administrative court, they should at least pay the state duty equivalent to the administrative act, so that there is a risk that if they do not win the case, they may lose that money. Therefore, there will be no dramatizations of administrative lawsuits," said the MP.
