The Case is Subject to Closure: Special Opinions of Two Constitutional Court Judges Published

The special opinions of Constitutional Court judges Arman Dilanyan and Felix Tokhyan regarding the application of Robert Kocharyan's attorney have been published on the Constitutional Court's website.

In his special opinion, Felix Tokhyan wrote, "There was no alleged legislative gap in this case. The resolution of the issue is entirely within the jurisdiction of the legislative body. It is unreasonable to consider provisions of the law unconstitutional and invalid solely by interpreting them, especially conditioned by a gap in the law. I am convinced that the Supreme Court would reach a different conclusion in this case if it had not shown some haste concerning this complex and publicly resonant issue."

Arman Dilanyan stated, "I am convinced that based on Robert Kocharyan's application regarding Articles 35 and 135 of the Criminal Procedure Code of the Republic, the proceedings to determine the constitutionality are subject to closure."
