«Haykakan Zham». Vahe Grigoryan Opens Overton's Window

«Haykakan Zham» writes: An interesting situation has arisen around the Constitutional Court not only concerning the newly elected chairman but also regarding the recent decision of the Court of Appeals related to Kocharyan. One of the former members of the Constitutional Court believes that Vahe Grigoryan is merely creating a show. “From a political science perspective, he is opening Overton's window. It is clear that the main target at this moment is Robert Kocharyan's case, which is set to be reviewed in the Constitutional Court on August 29, but the absurdity lies in the fact that Grigoryan cannot participate in the review of this case as an interested party; he was a legal successor of the victims of March 1st, and furthermore, the famous wiretaps prove that he is not a neutral person.”

This “show,” according to our interlocutor, serves a particular purpose: “It is an attempt to exert pressure on the public and the Constitutional Court so that the public understands that Kocharyan is the ‘eternal guilty party,’ and that the Constitutional Court and its members should conduct themselves ‘restrainedly’ during the examination of Kocharyan’s case.”

What does “restrained” mean? “You know, the atmosphere in the Constitutional Court is not unambiguous at this point – Vahe’s so-called ‘terrorist show’ has already achieved a certain goal. If any of the Constitutional Court members writes a special opinion, say, concerning the decision related to Kocharyan, and disagrees with the decision made by the Constitutional Court, then there will be an issue of implementation.”

By the way, there are already two such individuals in the Constitutional Court who have written special opinions – one relating to the retroactive application of the law on the illegal enrichment of Vachagan Ghazaryan (Serzh's Vacho) and the decision and detention concerning Robert Kocharyan in relation to the appellate court's previous decision. The essence of the government’s calculation is based on the thesis of a special opinion, in case the Constitutional Court decides in favor of Kocharyan.
